Canadian Print Shop Chemical Inventory Reporting: Scope

Canadian print shop chemical inventory reporting separates WHMIS product records from provincial waste manifests in Ontario, BC and Quebec.

What to take away

  • Canadian print shop chemical inventory reporting splits into federal programs — the National Pollutant Release Inventory under the Canadian Environmental Protection Act, 1999, and WHMIS labelling under the Hazardous Products Act — and provincial waste rules in Ontario, BC and Quebec.
  • Ontario, BC and Quebec each have a workplace safety regulator and an environmental regulator. A print shop can file the right WHMIS records and still miss a hazardous waste manifest.
  • A compliant WHMIS label carries a product identifier, hazard pictograms, a signal word, hazard statements, precautionary statements and the supplier identifier.
  • The NPRI threshold is set per substance in the current notice, not in the statute, so the list has to be checked every year.
  • Skipping provincial reporting can produce inspection orders, stop-work directions or fines from a named provincial regulator.

Federal WHMIS 2015 sets the common chemical language

Health Canada administers WHMIS under the Hazardous Products Act and Hazardous Products Regulations. The 2015 update aligned Canadian labels and safety data sheets with the Globally Harmonized System, but it did not remove provincial workplace enforcement. WHMIS is hazard communication inside the workplace, not a report filed with a regulator; the federal reporting duty a print shop runs into is the National Pollutant Release Inventory.

Ontario workplaces follow Ontario Regulation 860 under the Occupational Health and Safety Act. The regulation sets employer duties for WHMIS labels, safety data sheets and worker education.

Print shops with solvents, blanket washes, inks and cylinder cleaners must keep a current inventory of hazardous products on site. The US Hazard Communication Standard uses similar pictograms, but it does not notify a Canadian province. OSHA and EPA compliance covers the American duties, not the Canadian ones.

Federal reporting: the National Pollutant Release Inventory

Chemical inventory reporting in Canada has a federal reporting arm as well as a labelling arm. The National Pollutant Release Inventory is the federal release-reporting program, administered by Environment and Climate Change Canada under the Canadian Environmental Protection Act, 1999. A facility that manufactures, processes or otherwise uses a listed substance in an amount above the threshold set for that substance must report its releases, disposals and transfers for the year.

The threshold is not written into the statute. The notice issued for each reporting year carries the substance list and the threshold that applies to each one, and the report goes to Environment and Climate Change Canada by the deadline that notice sets. A shop using solvent-based press wash, blanket wash or parts cleaner checks the current list, because last year's answer can be wrong this year.

Ontario, BC and Quebec manifest duties differ

Ontario's Ministry of the Environment, Conservation and Parks administers hazardous waste rules under the Environmental Protection Act and Regulation 347. A print shop generating waste solvents or ink cleanup rags may need to register with the ministry as a generator and obtain a generator registration number, and each shipment then moves on a manifest that carries it. Regulation 347 also contains the exemptions that decide whether a given waste stream needs registration at all.

BC's Ministry of Environment and Climate Change Strategy enforces the Hazardous Waste Regulation under the Environmental Management Act, and WorkSafeBC enforces WHMIS in BC workplaces. In British Columbia, a manifest must be used when transporting more than the amount of hazardous waste indicated in the table prescribed under section 46(1) of the Hazardous Waste Regulation, the General Manifest Form may be completed by hand, typewriter or printer with each party in the shipment filling out copies, and when the hazardous waste quantity received is 5 percent greater or less than shown on the manifest the receiver must notify the director and submit an annual summary report (BC hazardous waste manifests).

In Quebec, CNESST enforces WHMIS, with the duties set in the Regulation respecting occupational health and safety under the Act respecting occupational health and safety. The Ministry of the Environment, the Fight against Climate Change, Wildlife and Parks tracks hazardous residual materials. Quebec's Regulation respecting hazardous materials under the Environment Quality Act sets generator duties for residual hazardous materials.

These are separate filing obligations. A shop can have a complete WHMIS binder and still fail to file a hazardous waste manifest. The reverse also happens: a shop registers as a waste generator but keeps no current chemical inventory for the safety regulator.

The same structure runs in the other provinces and territories: the province where the waste is generated supplies the registration and the manifest form. Alberta's Waste Control Regulation under the Environmental Protection and Enhancement Act, Manitoba's Environment Act and Saskatchewan's Environmental Management and Protection Act, 2010 are three examples.

A print shop that uses only a US SDS binder and skips a provincial manifest filing has no Canadian record of the hazardous waste shipment. That missing record is often where an inspector starts.

For a US state example, California Print Shop Solvent Ink shows solvent ink duties, but it does not replace an Ontario, BC or Quebec manifest.

What a compliant WHMIS 2015 label carries

A compliant label shows the product identifier, hazard pictograms, a signal word such as Danger or Warning, hazard statements, precautionary statements and the supplier identifier. Supplier labels must appear in both English and French in most Canadian workplaces. Ontario Regulation 860 also requires employers to keep safety data sheets readily available for workers.

The US Hazard Communication Standard label has similar elements, but it does not count as a Canadian supplier label. 1910.1200 describes the US duty, which is separate from WHMIS.

Records a print shop should keep

  • Safety data sheets for each hazardous product on site.
  • A chemical inventory that lists product, quantity and storage location.
  • Provincial hazardous waste generator registrations and manifest copies.
  • WHMIS education and training records for workers.
  • NPRI reports and supporting calculations, where a listed substance crosses its threshold.
  • Inspection orders and corrective action records.

Keeping these records does more than satisfy an inspector. It shows whether a shop has the same chemical names in its WHMIS inventory and its provincial manifest. For stock and supply control beyond chemicals, see print shop's stock control.

What happens if a print shop skips reporting

Ontario Ministry of Labour inspectors may enter a workplace without a warrant and order production stopped where a WHMIS inventory is missing. Under the Occupational Health and Safety Act, a corporation can be prosecuted for failing to comply with an order.

WorkSafeBC and Quebec's CNESST have similar inspection and order powers.

When a Canadian shop buys used equipment from American trade printers, it inherits US labels and must convert them to WHMIS labels. Buying used imprint machinery explains that purchasing path.

Common questions

Does a small print shop need to register as a hazardous waste generator in Ontario?

Small size alone does not determine the duty. Under Ontario Regulation 347, generator registration and manifest requirements depend on the waste and applicable exemptions; confirm the requirements with the Ministry of the Environment, Conservation and Parks.

Is a WHMIS 2015 label the same as a US HazCom label?

No. WHMIS 2015 uses similar pictograms and signal words, but Canadian supplier identifiers and bilingual requirements apply. A US label does not satisfy Canadian workplace duties.

Who enforces chemical inventory rules in BC?

WorkSafeBC enforces WHMIS in BC workplaces, while the BC Ministry of Environment and Climate Change Strategy handles hazardous waste manifests.

Does a print shop have to report to the National Pollutant Release Inventory?

The duty turns on the substance and the amount. The National Pollutant Release Inventory, run by Environment and Climate Change Canada under the Canadian Environmental Protection Act, 1999, applies to a facility that manufactures, processes or otherwise uses a listed substance above the threshold published for that substance in the current NPRI notice. A shop below every applicable threshold does not file.

What is the most common compliance gap in Canadian print shops?

Missing provincial manifest or generator registration because owners follow US RCRA guidance and do not file with a Canadian regulator.
